Deadline Approaching for Affordable Care Act Notification

If you are an employer subject to the Fair Labor Standards Act (if you’re required to pay minimum wage), you are required to let your employees know about:

  • Healthcare exchanges
  • Subsidies that may be available to them to purchase healthcare coverage
  • Tax and financial implications to choosing exchange coverage

This information has to be provided to your employees by Oct. 1.

If you have not received this information and it’s relevant to you and your employees, the National Restaurant Association (NRA) has information in its “Health Care Primer.” This information is specifically covered on pages 24-25 of that document, which you can download from the website.

The NRA has also developed an online tool that is free for members and allows operators to send their employees to receive the notice and sign off that they have read the notice. The system will track who has been notified. Find that here, but only if you’re an NRA member.

There are no penalties for not notifying your employees, but the law says you need to do it. Here is information on that matter from the Department of Labor.

I encourage you to review the resources available through the NRA before the Oct. 1 deadline gets the better of you. It’s almost here.
